Article IV. Garbage and Yard Refuse Service.*
Sec. 23C-4-3. Exceptions to exclusive right of collection and transportation.
(a) Any person may apply to the city manager for a permit to transport his
own garbage, wet garbage, rubbish, refuse, or yard refuse from his premises
subject to conditions reasonably related to protection of public health and
welfare. Such permit, however, shall not be approved without a showing of
compelling circumstances. Persons operating industrial or commercial uses may
transport the same without obtaining such permit.
(b) Yard Refuse. When the
city contracts with separate contract agents to handle garbage and yard refuse,
the contract agent handling garbage may collect and transport yard refuse placed
within garbage receptacles, but the contract agent handling yard refuse shall
have the exclusive right to collect and transport yard refuse placed in public
rights of way as provided hereinafter.
(c) Emergency Removal of Unsanitary
Materials. Nothing in this chapter shall be deemed to prohibit the removal and
hauling by a private person of materials considered by the city sanitation
officer or the city police chief or the city fire chief to constitute a health
menace of such nature as necessary to be ordered by any one of those officers or
their designated representatives to be promptly removed. (Ord. No. 1038, §
