Sec. 21-7-2. Stay of time period due to lawsuit.

(a) If approved by the community development director, the period of time specified in Section 21-7-1, including any extension thereof, shall not include the period of time during which a lawsuit involving the approval or conditional approval of the tentative map is or was pending in a court of competent jurisdiction.
(b) After service of the initial petition or complaint in the lawsuit upon the city, the subdivider may apply to the city for a stay.
(c) Within forty days after receiving the stay application, the community development director shall either stay the time period for up to five years or deny the requested stay.
(d) Appeals of the decision of the community development director shall conform to the procedures of Section 21-6-2. (Ord. No. 1500, § 3 (part).)
