Sec. 20-7-5. Same--Regulations.

Encroachment permits for the painting of property addresses on curbs may be issued subject to the following conditions and duties imposed thereby to be performed by the permittee:
(a) Consent in writing shall be secured from the property owner prior to the painting of his property address on the street curb fronting his property.
(b) There shall be a written agreement between the permittee and the property owner stating the cost of the work prior to the actual performance of the painting. No property owner or occupant of any property shall be liable for any payment, compensation, donation, or other consideration relating to the painting of address numbers on street curbs fronting his or her property unless the property owner agreed in writing prior to the painting to make such payment.
(c) Permittee shall record the address number of all properties, with their corresponding owners’ name, that receive address painting. Permittee shall submit such records, or copies thereof, to the director of public works upon request.
(d) Permittee shall take out, carry, and keep in force public liability insurance in the amount of three hundred thousand dollars minimum. Permittee shall also obtain a certificate of insurance naming the city as additionally insured to accompany the application, the form of which shall be subject to the approval of the city attorney’s office.
(e) The permittee shall be responsible for all claims and liabilities arising out of work performed pursuant to the permit issued, or arising out of the permittee’s failure to perform any of the obligations imposed by this article. The permittee shall, and by acceptance of the permit agrees to, defend, indemnify, and save and hold harmless the city, its officers, employees and agents, from and against any and all suits, claims, and actions brought by any person for bodily injury and/or property damage and/or other injury or damage sustained in or arising out of the work performed pursuant to the permit or in consequence of permittee’s and his/her agent’s failure to perform the obligations with respect to the painting of address numbers on curbs and other obligations imposed by this article.
