Sec. 20-6-3. Removal of advertising signs/displays, newsracks, modular newsracks, chairs and/or tables in violation.

(a) Any advertising sign/display, newsrack, modular newsrack, chair and/or table placed, used or maintained in violation of this article or of conditions attached to the permit issued pursuant to this article may be posted with a notice of violation by the director of public works. The notice shall direct the permittee or, if no permit has been issued, the owner of the advertising sign/display, newsrack, modular newsrack, chair and/or table to remove the advertising sign/display, newsrack, modular newsrack, chair and/or table or bring it into compliance with the provisions of this article. The notice shall also provide that failure to correct the violation may result in removal and destruction of the advertising sign/display, newsrack, modular newsrack, chair and/or table.
(b) Upon posting the notice of violation, the director of public works shall send written notification of the violation for which such posting was made to the permittee or owner as the case may be, if the address of said permittee or owner can be determined by the director of public works. Said notification shall: (1) state the nature of the violation; (2) state the date of posting of the advertising sign/display, newsrack, modular newsrack, chair and/or table(s) so found in violation; (3) require the correction of the violations within ten days from the date of said notice; and (4) set the date, time and place of a hearing to be held by the director of public works which date shall not be less than twenty-one days from the date of written notice on the question of the violation(s).
(c) Any advertising sign/display, newsrack, modular newsrack, chair and/or table which is not brought into compliance with the provisions of this article or with the conditions attached to a permit within thirty days of the hearing held by the director of public works shall be deemed abandoned. The director of public works may remove and destroy any advertising sign/display, newsrack, modular newsrack, chair and/or table found to be so abandoned. (Ord. No. 1201, § 2 (part).)
