Article I. Lost and Abandoned Property.
Sec. 17A-1-6. Disposition of property found.
(a) Property received by the police department and not delivered to the
true owner or the finder shall be disposed of pursuant to this section within
thirty days following the end of the three-month period.
(b) If the police
chief, or his or her designee, determines that the property is of a kind that
may be sold at auction, the property shall be sold to the highest bidder at an
auction open to the public unless appropriated for use by the city.
property offered for sale at an auction and not sold, and not suitable for
appropriation by the city, shall be deemed to be of no value and shall be
disposed of in a manner to be determined by the police chief, or his or her
designee; provided, however, that no such items shall be given or sold to
officials, officers, or employees of the city or their relatives.
(d) If the
police chief, or his or her designee, with the consent of the city manager,
determines that the property is needed for a public use, the item may be
appropriated by the city. Any items so appropriated shall be delivered to the
appropriate city department by the police department.
(e) If the police
chief, or his or her designee, determines that the property is not of a kind
that may reasonably be sold at auction, the police chief, or his or her
designee, shall make all necessary and appropriate arrangements for the
destruction of the property.
(f) Notwithstanding any other provision of this
article, any lost or abandoned property in the possession of the police
department that the police chief, or his or her designee, reasonably determines
to be dangerous or perishable may be disposed of immediately, without notice, in
a manner to be determined by the police chief, or his or her designee. (Ord. No.
