CHAPTER 21. SUBDIVISIONS.
Article 9. Final Map and Parcel Map.
Sec. 21-9-9. Review and approval of parcel and final maps.
(a) The city shall disapprove a map for failure to meet or perform any of
the requirements or conditions imposed by the Subdivision Map Act or this
chapter which were applicable to the subdivision at the time of approval of the
tentative map. Such disapproval shall be accompanied by a finding identifying
the requirements or conditions which have not been met or performed. When the
failure of the map is the result of a technical and inadvertent error, which, in
the determination of the community development director, does not materially
affect the validity of the map, the provisions of this subsection may be waived
in the discretion of the community development director.
(b) The review and
approval of parcel and final maps shall be as stated below:
(1) Parcel Maps.
Pursuant to Section 66450 of the Subdivision Map Act and Section 21-9-8, the
city engineer shall examine the parcel map. Within twenty days from the time the
parcel map is submitted to the city engineer, he or she shall complete the
statement required by Section 21-9-8(a) and deliver the completed parcel map to
the city clerk to be transmitted to the county recorder for
recordation.
(2) Final Maps. Pursuant to Section 66442 of the Subdivision
Map Act and Section 21-9-8, the city engineer shall examine the final map.
Within twenty days from the time the final map is submitted to the city
engineer, he or she shall complete and file the statement required by Section
21-9-8(a) with the city council. After all required certificates or statements
on the map have been signed and, where necessary, acknowledged, the final map
may be filed with the city council for approval. The city council shall, at the
meeting at which it receives the map or, at its next regular meeting thereafter,
approve the map if it conforms to all requirements of the Subdivision Map Act
and this chapter as applicable at the time of approval or conditional approval
of the tentative map. If the map does not conform, the city council shall
disapprove the map. After approval by the city council, the map shall be
forwarded by the city clerk to the county recorder for recordation. (Ord. No.
