The permittee shall be responsible for all claims and liabilities arising out of work performed pursuant to the permit, or arising out of permittee’s failure to perform the obligations with respect to the drilling and maintenance of groundwater monitoring wells. The permittee shall, and by acceptance of the permit agrees to, defend, indemnify, and save and hold the city, its officers, employees and agents, from and against any and all suits, claims, and action brought by any person for bodily injury and/or property damage and/or arising out of work performed pursuant to the permit or in consequence of permittee’s and his/her agent’s failure to perform the obligations with respect to the drilling and maintenance of groundwater monitoring wells.
