CHAPTER 20. STREETS AND SIDEWALKS.*
Article I. General Provisions.
Sec. 20-4-4. Same--Not to be in conflict with certain regulations.
All work performed pursuant to a permit issued shall be in compliance with
the following regulations:
(a) All sidewalk work shall be done under the
direction, supervision, and to the satisfaction of the director of public works,
and must be constructed in accordance with the City Standard Plans and
Specifications on file in the office of the director of public
works.
(b) All prepared subgrades and surfaces shall be inspected and
approved by the director of public works before any concrete is poured. All
completed work shall be subject to approval by the city. At least twenty-four
hours advance notice shall be given to the city by the permittee so that the
city may schedule inspections.
(c) No sidewalk shall be constructed of
anything other than concrete, unless prior approval is obtained from the
director of public works.
(d) All debris and surplus materials shall be
removed promptly upon completion of the work.
(e) The permittee shall
maintain the premises in a safe manner and shall provide adequate barricades,
lights or other safety precautions at his/her own expense as may be necessary to
adequately protect the safety of the public using the adjacent streets or
sidewalks.
(f) The permittee shall be responsible for all claims and
liabilities arising out of work performed pursuant to the permit, or arising out
of the permittee’s failure to perform the obligations with respect to
sidewalk construction and maintenance or to provide all public safety facilities
required by law. The permittee shall, and by acceptance of the permit agrees to,
defend, indemnify, and save and hold harmless the city, its officers and
employees, from and against any and all suits, claims, or actions brought by any
person for bodily injury or property damage and/or other
injury sustained in
or arising out of the construction or the work performed pursuant to the permit
or in consequence of permittee’s failure to perform the obligations with
respect to sidewalk construction and maintenance and to the provision of all
public safety facilities required by law. (Ord. No. 1201, § 2
